It Finally Caught Up

To anyone looking at this who was curious as to why all of my work is down from Jamendo, here’s why:

You all know that I use samples… I don’t really try to hide it. It’s not as shameless as a lot of hip-hop artists can be today, but they’re still there – about as shameless as Fatboy Slim, The Dust Brothers, Beck, any one of my heroes. This music wasn’t made with the idea that it was going to be sold or put on a mass market. However, that seems to have changed. I’m going to have to start being very careful now, especially with the success I’ve garnered from Jamendo, the success that Jamendo has garnered for itself, and how quickly things can happen over the internet these days. The full albums will be made available through other sources and not under the CC license. I’ll be putting together a compilation of “clean” tracks, that is, without obvious samples, and then put it back up on Jamendo with a description explaining why this happened.

Patrick Haour from Jamendo brought it to my attention today, and while it was a tad upsetting at first, I’d much rather hear it from him than someone at a massive label or a lawyer.

So don’t panic. Everything should be alright. I’ll keep you folks updated. Thanks again for the all the support.

  3. Rurastic… I was about to peg you as an uninformed asshole. Then I read your previous comment, and it makes a bit more sense why you say what you did, but I still think you’re missing the point a bit.

    Even non-profit organizations have payrolls. The chicago anti-hunger federation distributes over 1 million dollars worth of healthy food every year, and has a 500,000 payroll in their 1.9 million dollar budget. That is a very low percentage compared to some other organizations.

    My point is, that if someone wants to spend their life making music, there has to be some form of income from it. How else would you pay the bills? Income from your art means you can make more art! I would bet you my first born, that if PK did get signed to Ninja Tune, Illegal Art, or wherever, that there would still be plenty of CC licensed music released besides studio albums. I don’t think he would sign a contract that doesn’t allow him to still distribute free (as in beer and speech) music.

    The CC community has been so incredibly supportive in every aspect of Professor Kliq that you can imagine, and I would stab him in the face before I let him even turn one cheek to what is an amazing community and concept.

    Any music that CAN be allowed under the CC license WILL be. There will be some that will have to be released under another, slightly less free (as in speech) license to give respect to those artists who have chosen not to be a part of that community.

    Overall, nothing horrible is happening here, and the albums were temporarily removed until the situation is fully assessed, and out of respect for Jamendo.

    Overall, I think life getting “worse” is very much overstated. It’s just being careful, and trying to respect the music community (CC and other) as much as possible.

  5. I think you should consider this a mark of success more than anything else. I know you guys understand the importance of CC, but we can’t escape the fact that a lot of the music out there just isn’t CC. Some of the samples were bound to catch up eventually. Clearing them all can be a nightmare and I’m reminded of Public Enemy’s high profile court cases over sampling in the early 90’s. Sadly music copyright law was never designed to deal with the way the technology works today, it still hasn’t caught up. Legal things can rightly be a concern but don’t let it get you down.

    A lot of people will criticise this move and I can see their position to some extent but they should think about this, you’re protecting Jamendo. A community we all love. A situation has arisen that could be difficult for them, not by design but by accident. Makes sense to take measures now to avoid problems, for both parties. Good luck with getting the stuff remixed and back up onto Jamendo, I know it’s a lot of work but I appreciate it. Keep making music, keep having fun. Good things will come :)

  6. I understand the move however music that once was CC will always be. You cannot change that. All people that downloaded your music still can upload it somewhere (archive.org, bittorrent sites etc…)

    So as much as I can understand, you’re protecting jamendo, but there’s no way to “discard” what you’ve done up to now. One more reason to fight for laws that catch up with time.

  7. My work as it’s free, so much as I know, is fine… and that was the intent all along. Though I wonder if I’ve somehow violated the CC protocol. Don’t get me wrong, I have tracks that are safe to use and I do fully intend on remaining true to CC and everything it stands for. There are just certain tracks I can’t rightfully put up as such. I didn’t know much about the concept and rules of CC when I put them up, but now I know, and I’ll work with it from here.

    The music that I’ve made, whether it has samples or not, has always been in the interest of making something that gives me peace of mind… even up to my last album, these tracks weren’t made for money, it was made for fun and as an outlet, as a hobby, as a passion. I’ll never do it for any other reason. Distributing comes first, getting paid comes distant second. The little bit of money I made from Jamendo helped with little things, things that I needed… I didn’t buy a car with it, I don’t use it to pay rent in an expensive apartment… it was comperable to half of a part time job. It wasn’t much, but it was nice to know that my work was appreciated enough to generate a little revenue. But that was it.

    I’m not trying to personally dick the CC Community and it’s not my intention to turn my back on it because of a rule that some people might assume that I think is “stupid” or “unfair”. Because it’s not. I completely understand which is why I’m not fighting it and it’s my full intention to cooperate and keep those in the CC community who have truly been good to me (which is everyone I’ve ever dealt with) out of trouble or even in an uneasy situation. There’s still some clean-up work to be done, but it’ll be alright. Professor Kliq has not vanished from the CC community, just taking a step back to reevaulate and make sure that I’m staying true to the CC code.

  8. @anon: You are partly correct. Those tracks released under CC license will keep this license – it can not be undone. But if tracks violated the copyright of others, redistributing these tracks (e.g. by uploading/sharing) would still be a copyright violation. Therefore in the interest of Jamendo and other sites they had to be removed. Hope to hear soon from Mike which tracks were safe, so that some of his great work can go back online.

  9. I’m happy in a way to read this. I was wondering what was going on with the such cool music I heard on Jamendo a few days ago. I went back to download it and couldn’t find it anymore and was getting resigned.

    I hope you get your tunes up and running fast, in the meanwhile, could we still have the ones on Jamendo? Please…!?

    I’m real keen to use “Bust This Bust That” for a animation showreel. I’ll be waiting in a cat like readiness for your update of that track!
